PROMAX data protection terms and conditions

PROMAX Test & Measurement SLU (hereinafter, “PROMAX”) complies with the current legislation in Spain and the European Union in the processing of the personal data of its customers. For this purpose, it adopts the necessary technical and organizational measures to avoid the loss, misuse, alteration, unauthorized access, and theft of the personal data provided. In accordance with data protection laws, we would like to inform you about how we handle your personal information.

1. WHO IS RESPONSIBLE FOR PROCESSING THE CUSTOMER'S DATA?

The responsible party will be PROMAX Test & Measurement SLU, with Tax Identification Number: B02865004 and registered office located at C. Francesc Moragas, 71 08907 L'Hospitalet de Llobregat (Spain).

2. WHAT IS THE PURPOSE AND LAWFUL BASIS FOR OUR PROCESSING OF CUSTOMER DATA?

The following are the purposes for which customer data is processed:

Updates to pricing, promotion sending, as well as information regarding improvements to the features of PROMAX products and services.

This purpose includes using the customer's personal data to send communications regarding service provision, updates, improvements, and promotional offers for new rates or additional value-added services that may be of interest to the customer.

This advertising information will be sent through any channel (emails, phone calls, etc.) and may be generic or personalized. In the latter case, it will be based on the prior processing of the customer's data with the aim of profiling them, determining their preferences and needs, and, based on these, identifying the offers that may be of greatest interest. The purpose of this is to send the customer only the information that we believe may be of interest to them. The customer may at any time object to the sending of new commercial communications, and may exercise this right by postal mail to the address stated above, by email to the address promax@promax.es, or through our customer service.

To analyze the customer’s traffic, browsing, and geolocation data in order to develop commercial actions

PROMAX may analyze the customer's traffic, browsing, and geolocation data to gain a better understanding of their preferences and needs in order to develop commercial actions related to products and services.

Sharing of customer data with group companies and members of its commercial network

PROMAX will only share customer data with companies within our group for the purpose of information sharing and, through the analysis of aggregated data, conducting statistical studies that will enable us to carry out commercial actions of greater value for both parties. Also to share manufacturers, distributors, and representatives. Additionally, to enable other group companies to directly contact the customer via any communication channel for the purpose of marketing their products or services.

3. WHAT KIND OF DATA DO WE PROCESS?

For the purposes outlined in the preceding paragraph, we process the customer's data, which can be divided into the following sources and categ:

Data directly supplied by the customer:

Data provided directly by the customer or information requests submitted through the customer service department. The customer is responsible for its accuracy and updating.

Data obtained from sources other than the customer itself:

Data obtained from sources other than the customer, either with their consent or under any other legal authorization (legitimate interest, compliance with a legal obligation, etc.). These sources include:

• Personal data voluntarily contributed by the customer to public domains like social media platforms or online communities.
• Public Administration Bodies, State Tax Agency or Judiciary.
• Common credit information systems.
• Identity protection and data fraud detection records.

4. WITH WHOM DO WE SHARE THE CUSTOMER’S DATA?

Personal data processed by PROMAX to achieve the purposes outlined above may be shared with companies within the PROMAX group and members of its commercial network, but in no case with third-party companies.

5. FOR HOW LONG WILL WE KEEP CUSTOMER DATA?

Personal data shall be retained for as long as the customer's consent is in effect. The customer may unsubscribe from our database at any time.

6. CUSTOMER RIGHTS

Our data protection regulations grant the customer a series of rights regarding the data processing involved in our services, which can be summarized as follows:

• Right to access: To find out what type of data we are processing and the features of the processing we are undertaking.
• Right to rectification: The ability to request the modification of a customer's data if it is inaccurate or untrue.
• Right to limitation of processing as stipulated by law.
• Right to erasure: To request the deletion of the customer's data when the processing is no longer necessary.
• Right to opt-out: To request to be excluded from receiving marketing communications under the previously stated terms.
• Right to revoke consent: The request to revoke consent will be processed within approximately 30 days.
• Right to lodge a complaint with the supervisory authority (in Spain, AEPD).
